Step 1 - Pre-Consultation
We strongly encourage you to consult with forestry staff prior to submitting this application to determine if an application is required.
Step 2 - Tree Marking
Trees to be injured or destroyed shall be marked by a certified tree marker with a vertical line of paint near the inner root flare below the cut line on both sides of the tree. The paint must be clearly visible to the County. If paint marked near the inner root flare is not visible, it shall be marked at an alternate location as approved by the County.
Step 3 - Application Submission Requirements:
This application must be accompanied by:
- The prescribed fee of $104.00. Fee's can be paid online at https://webforms.brant.ca/Finance/Bylaw-Fees
- A copy of a silvicultural prescription prepared and signed by a qualified Ontario Professional Forester Association Member, in which the prescription must be prepared in accordance with good forestry practices
In order for this permit application to be deemed complete, the silvicultural prescription shall include the following information:
- Property Location: Civic address, legal description, tax roll number and a sketch or map of the subject property.
- Sketch or Map (must be legible and can be either hand drawn or in electronic form):
- North Arrow.
- Roads and crossroads identified by name.
- Access to harvest area, landing and/or skid trail locations.
- Natural features such as but not limited to wetlands, streams, valleys, ponds, significant, rare or endangered wildlife habitats.
- Dwellings, structures, fences whether accessory or not and other distinguishing features.
- Property boundaries, including outline of woodland boundary and outline of harvest area boundary.
- Proposed location where a copy of the Notice Sign will be posted on site.
- Maps may be created using digital mapping found on the County of Brant website https://www.brant.ca/en/county-government/Downloadable-Maps.aspx The County takes no responsibility and makes no representation in any way to or for users accessing these maps.
- Silvicultural Prescription:
- Woodland description.
- Short-term and long-term management objectives.
- Stand analysis including pre-harvest, target and residual basal areas.
- Tree marking prescription.
- Identification of key natural heritage features and key hydrologic features.
- Prescribed methods of harvesting.
- Quantity, species and size of trees to be harvested.
- Authorization and Contact Information:
- The names, addresses and contact information of all parties (landowner, person in charge of harvesting trees, Qualified Ontario Professional Forester Association Member, Certified Tree Marker, and contractors.
- Proof of a valid homeowner’s liability insurance policy.
Step 4 -Notice of a Complete Application
Once the application has been deemed complete, a site inspection shall be completed by the County. If all of the necessary requirements have been fulfilled and the County is satisfied that harvesting is to be undertaken in accordance with good forestry practices, the County will issue a receipted copy of the application to the mailing address or email address provided on the form.
Step 5 - Property Notice Sign
The applicant shall erect and display the Notice Sign at the entrance of the area to be harvested in a location that is clear and visible to all persons, and the notice shall be in the form prescribed and supplied by the County. The Notice Sign shall remain on display until the approved harvesting of trees has been completed. A photograph of the sign shall be sent to the tree conservation email.
Step 6 - Notify the County prior to Start of Tree Removal
The applicant shall notify the By-Law Enforcement Division, by telephone or email, no more than seven (7) business days and no less than 24 hours prior to the date upon which the injury or destruction of trees is to begin advising of the date upon which the injury or destruction of trees is to start.
Permit Approval Length:
The permit is valid for a term of two years from the date of its issuance and is not transferable. If the activity for which the permit was issued has not taken place within the time frame of the permit, such permit shall lapse and shall be of no effect. No fees shall be refunded.
Terms:
Prior to the expiry of the permit, the applicant may request in writing to the County, that the permit be extended. At the discretion of the County, permits may be extended one time only for an additional period of not more than one year from the date of extension.
Indemnification and Hold Harmless Clause
The Applicant shall defend, indemnify and save harmless the Corporation of the County of Brant, its elected officials, officers, employees and agents from and against any and all claims of any nature, actions, causes of action, losses, expenses, fines, costs (including legal costs), interest or damages of every nature and kind whatsoever, including but not limited to bodily injury, sickness, disease or death or to damage to or destruction of tangible property including loss of revenue or incurred expense resulting from disruption of service, arising out of or allegedly attributable to the negligence, acts, errors, omissions, misfeasance, nonfeasance, fraud or willful misconduct of the Applicant, its directors, officers, employees, agents, contractors and subcontractors, or any of them, in connection with or in any way related to the delivery or performance of this Permit. This indemnity shall be in addition to and not in lieu of any insurance to be provided by the Applicant in accordance with this Permit and shall survive this Permit.
The Applicant agrees to defend, indemnify and save harmless The Corporation of the County of Brant from and against any and all claims of any nature, actions, causes of action, losses, expenses, fines, costs (including legal costs), interest or damages of every nature and kind whatsoever arising out of or related to the Applicant’s status with WSIB. This indemnity shall be in addition to and not in lieu of any proof of WSIB status and compliance to be provided by the Applicant in accordance with this Permit, and shall survive this Permit.
It is the owner’s responsibility to ensure that the logger has liability insurance and complies with the Workplace Safety & Insurance Board requirements.
